Regulator & Licensing

The Lotería Nacional de Beneficencia de El Salvador (LNB) is the regulator and, in some cases, operator. Authorisations (via permit, contract, concession or public-private partnership) can run up to ten years. A key distinction for players:

  • LNB-authorised operators are subject to Salvadoran oversight and consumer protection.
  • Offshore operators (often carrying Malta Gaming Authority or Kahnawake licences) accept Salvadoran players but are regulated abroad, so local remedies do not apply.

Crypto Status

El Salvador made Bitcoin legal tender in 2021, but under its ~US$1.4bn IMF programme it reversed the mandatory elements. Decree No. 199, published in the Official Gazette on 30 January 2025, removed the word ‘currency’ from the Bitcoin Law, made acceptance voluntary, and stopped Bitcoin being usable to pay taxes or government debts. Reporting notes the amended text still references ‘legal tender,’ which analysts have described as contradictory given the removed obligations. There is no specific crypto-gambling licence, so crypto used at betting sites relies on this general framework plus each site’s own rules.

Winnings Tax

Gambling and lottery prizes are taxed through income-tax (ISR) withholding under Article 160 of the Tax Code. Payers must withhold 15% on prizes from contests, lotteries, raffles, draws and games of chance paid to domiciled recipients. For prizes paid by the LNB (and certain public-utility entities), the 15% applies only to amounts above 30 minimum monthly salaries; prizes at or below that threshold are treated as non-taxable income. Non-residents are withheld 25% regardless of amount. Because the withholding is a definitive payment, correctly withheld prizes generally do not need to be re-declared.
